Transportation Release Agreement

Parties

Releasing Party Name: Choices Murphy Pregnancy and Family Center 

Releasing Party Address: 1262 Andrews Rd. Murphy, NC 28906

WHEREAS, the Releasing Party has recommended Cherokee County Transit ("Transportation Company"), to the Receiving Party.

WHEREAS, the Receiving Party intends to engage the Transportation Company based on this recommendation;

WHEREAS, the Releasing Party wishes to be released from any liability or obligation arising from this recommendation;

NOW, THEREFORE, in consideration of the mutual promises herein, the parties agree as follows:

1. Recommendation Acknowledgment

The Releasing Party has provided a recommendation of Cherokee County Transit to the Receiving Party. Releasing Party makes no guarantees regarding the performance, reliability, or suitability of the Transportation Company for the Receiving Party’s needs.

2. Release of Liability

The Receiving Party hereby releases, waives, and discharges the Releasing Party from any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to the recommendation of the Transportation Company.

3. Release of Bodily Injury

The Receiving Party expressly releases the Releasing Party from any and all liability for bodily injury, including but not limited to physical harm, illness, disability, or death, that may occur to the Receiving Party, its employees, agents, or any third party, arising directly or indirectly from the use of the Transportation Company’s services based on the Releasing Party’s recommendation. The Receiving Party acknowledges that this release includes any bodily injury.

4.  No Warranty

 The Releasing Party provides this recommendation without any express or implied warranties. The Receiving Party acknowledges that it is solely responsible for conducting its own due diligence and entering into any agreement with the Transportation Company at its own risk.

5. Indemnification

 The Receiving Party agrees to indemnify and hold harmless the Releasing Party from any claims or actions brought by third parties as a result of the Receiving Party’s use of the Transportation Company based on this recommendation.

6. Governing Law

 This Agreement shall be governed by and construed in accordance with the laws of the state of North Carolina.

7. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or understandings, whether written or oral, relating to the subject matter herein.

8. Duration of Release 

The releases and waivers set forth shall remain in full force and effect for the entire duration that the Receiving Party remains a client of Choices Murphy Pregnancy and Family Center, including any renewals, extensions, or subsequent engagements with the Transportation Company based on the original recommendation. This release applies to all incidents, claims, or damages occurring at any time during this period, regardless of when such claims are discovered or asserted.

INFORMATION

Purpose of Release:

 This Release of Information authorizes the disclosure of certain information related to the recommendation and use of recommended services, as described below:

1. Authorization to Release Information

I hereby authorize the Releasing Party to disclose to the Transportation Company the personal information listed below

Name, address, phone number, email address, appointment date and time.

2. No Liability for Disclosure

The Receiving Party acknowledges that the Releasing Party is not responsible for the accuracy, completeness, or consequences of the information disclosed under this authorization. The Receiving Party releases the Releasing Party from any liability arising from the use of this information.

3.  Privacy Acknowledgment

I understand that the information released may include sensitive or confidential data and that the Releasing Party agrees to use such information solely for the purpose of engaging the Transportation Company’s services.
